Juicies – Promotion

By submitting an entry into this promotion, you accept and agree to these terms and conditions and privacy policy. If you do not agree with any of these terms and conditions or the privacy policy, then you should not submit an entry. We recommend that you print, store or save a copy of these terms and conditions.

Who is running this promotion?

The promoter is TASMAN BAY FOOD Co (ABN 87 636 426 509) whose registered office address is 61 Factory Road, Brightwater, Tasman, New Zealand 7022 (“Promoter”).

By entering the promotion, you agree to be bound by these terms and conditions.

Who is eligible to enter this prize draw?

This promotion is only open to Australian and New Zealand residents.  

Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. 

Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.

Entrants must have a valid Instagram or Facebook account.

This promotion is not open to any of the Promoter’s employees or any subsidiaries, affiliates and suppliers or their immediate family.

What is the closing date?

The promotion opens on 24/02/2025 and closes at 11:59PM on 07/03/25. (the “Promotion Period”).

How do I enter?

To enter entrants must:

No purchase or payment is required.

Any entries which do not comply with these entry requirements, or which contain any third party intellectual property without prior informed consent from the rights holder, or which contain any abusive, inappropriate, offensive or obscene language or imagery will be disqualified. 

Examples of language/images considered to be inappropriate, offensive or obscene, include (but are not limited to): any message/image which contains (a) swearing; (b) comments or actions which appear to be discriminatory of any person, company or group of individuals, for example comments of a racist, sexist or homophobic nature; (c) sexual innuendo, sexual language or sexual acts, actions or gestures; (d) promoting any illegal unlawful activity such as drug use; (e) any message that appears to be an advertisement or solicitation to buy; and (f) any materials (whether written or visual) that directly or indirectly relate to Promoter’s competitor brands or that show any intention of promoting any brand other than Promoter brand.

Incomplete or indecipherable entries will be deemed invalid.

How many entries can I have?

Multiple entries are permitted, subject to the individual complying with all the eligibility criteria.

The entries are capped at 3 per person.

What is the prize?

There will be 30 winners.

The winner will receive 2 Juicies holders, selected by the Promoter, which will be sent to the winner by post, subject of availability.

Each prize pack will include:

  • 2x Juicies Holders

The total prize pool value is AUS $300

No cash alternative available.

No transfer or assignment of prizes will be permitted except by the Promoter.

The Promoter reserves the right to substitute prizes of equal or greater value.

How will the winner be selected?

30 winners will be selected by the Promoter solely on the merit of their response to “comment your favourite Juicies flavour and the best time to enjoy it”.

The Promoter will judge and select the winners on the basis of the creativity and originality of the response.

Any entries which are defamatory, obscene or otherwise not in accordance with Instagram Community Standards will be deemed invalid and shall be removed from the Promotion.

The selection of winners will be carried out by Milkbar Digital (the “Agency”) and will take place at on 11/03/2025 at 10am AEST.

The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.

How will the winner be notified?

Within two (2) business days of the draw, the winner(s) will be notified by a direct message on Instagram by @Juiciesau to confirm personal details.

The winner must reply to the notification within 5 days from the notification message date.

Please allow up to 30 days from the postal address details are supplied for delivery of the prize.

If no response is obtained within 5 days from the notification message date, the prize will be forfeited and may be awarded to an alternate winner selected in a random draw from the remaining eligible entries. 

Again, the promotion winner must reply to the notification within 5 days from the notification email date to claim the prize. 

There will be 3 alternate drawing(s) after which the prize will remain unawarded. The unclaimed prize will not be awarded.

Use of your personal information for this promotion

The Promoter is the data controller for the processing of personal data in connection with the promotion. The Agency will process personal data for the purpose of judging the entries to the promotion and selecting winners.

The Promoter will use your email address, name or any other contact details you provide for the promotion for purpose and duration of the promotion. The Promoter will use this information for the sole purpose of contacting you should win the promotion.

Liability

The Promoter is not responsible for late, lost, misdirected, mechanically reproduced, mis-delivered, incomplete, illegible, or unintelligible entries, messages or post; unavailable network connections; failed, incomplete, garbled, or delayed computer transmission; online failures; hardware software or other technical malfunctions or disturbances; or any other communications failures or circumstances affecting, disrupting or corrupting the promotion in any manner.

The Promoter is not responsible for any inaccuracy in the contact details supplied by the entrant that may result in the inability of the Promoter to contact that entrant.

The Promoter reserves the right to amend these terms and conditions or to cancel, alter or amend the draw or the prize due to any circumstances that arise beyond the Promoter’s control.

Promoter reserves the right to disqualify an entrant or winner that, in its absolute discretion, could bring Promoter into disrepute.

Promoter shall disqualify any entries that have failed to abide by and/or are in breach of these terms and conditions.

Promoter’s decision is final and no correspondence will be entered into.

The Promoter reserves the right in its absolute discretion to amend or waive any of these Terms and Conditions, or suspend or cancel the competition at any stage, in the event of circumstances that are unforeseen or beyond its reasonable control (including suspected or actual fraudulent or misleading practices or other breaches of these Terms and Conditions).

What laws apply to this promotion?

This promotion is governed by the laws of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia.

This promotion is in no way sponsored, endorsed or administered by or associated with Facebook, Instagram or any other social media channel. By entering, entrants acknowledge that Facebook and Instagram do not bear any responsibility for this promotion and, to the maximum extent permitted by law, entrants release Facebook and Instagram from any liability whatsoever in connection with this promotion. All information entrants provide when they enter the promotion is provided to the Promoter and not to Facebook, Instagram or any other social media channel.

What is Personal Information and why do we collect it?

Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect includes names, addresses, email addresses, phone and facsimile numbers.

This Personal Information is obtained in many ways including interviews, correspondence, by email, via our website, from your website, from media and publications, from other publicly available sources, from social media giveaways and promotions and from third parties. We don’t guarantee website links or policy of authorised third parties.

We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. TASMAN BAY FOOD Co will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal Information we may require identification from you before releasing the requested information.

It is an important to us that your Personal Information is up to date. We  will  take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.
